Terms and Conditions of Use

By logging into the Centers for Medicare & Medicaid Services (CMS) Medicaid HITECH Technical Assistance (TA) Web portal, you understand, agree to, and accept the terms and conditions listed below. Only approved members who are State Medicaid Agency employees and/or contractors are allowed access to the CMS Medicaid HITECH TA Web portal.

The Medicaid Electronic Health Record (EHR) Team (MeT) may revise and update the Terms and Conditions of Use at any time by posting the amended terms and conditions to this Web portal. Your continued use of the CMS Medicaid HITECH TA Web portal means you accept and agree to the revised Terms and Conditions of Use.

Informational Accuracy: The materials on this Web portal are resources that allow states to share information and network. The Web portal also contains shared information from other members. The MeT makes every effort to ensure the accuracy and reliability of the information presented on the CMS Medicaid HITECH TA Web portal. As a member of the HITECH TA Web portal, it is recommended that careful attention be made to the contents and artifacts provided, and that the originator of the data or information and the MeT ( be contacted with any questions regarding accuracy.

Information provided by CMS is identified as such and subject to updates and changes as needed. As always, the HITECH regulations must be the final and ultimate source of reference and compliance. CMS and the MeT do not guarantee the accuracy, completeness, efficacy, or timeliness of information posted when provided by members of the CMS Medicaid HITECH TA Web portal. CMS and the MeT also do not recommend or endorse specific tests, products, procedures, opinions, or other information provided by states or representatives.

Aside from approved CMS content, you may find content, opinions, responses to questions, and articles uploaded to this portal by other sources. This information solely represents the opinions and responsibility of the individual or entity submitting it and does not necessarily reflect the opinions of CMS. Understand that you are responsible for the content you submit, and you, not CMS, have full responsibility for such content, including its legality, reliability, and appropriateness. Privacy: The MeT is firmly committed to protecting the privacy of its Web portal users. The MeT assigns profiles to verify users’ identity. To become an active member and user of the portal, your identity and member status must be approved by CMS. Members must enter their contact information into a profile. This information is never disclosed or sold to third parties, but is available to other members. The MeT's Communities of Practice (CoP) page also provides member profile data (name, city, state, job title, and workplace) to other members through its online profile directory. You must agree to use portal directory information only for individual, personal, and confidential reference purposes. You must agree not to use this directory, in whole or in part, for mailing lists, solicitations, or other commercial purposes.

Accessibility: The MeT is committed to providing materials that are easily accessible to all users. To meet this commitment, this site is built to comply with the requirements of Section 508 of the Rehabilitation Act. Section 508 requires that individuals with disabilities, who are members of the public seeking information or services from us, have access to and use of information and data that is comparable to that provided to the public who are not individuals with disabilities, unless an undue burden would be imposed on us. Organization and/or corporate logos may only be displayed in shared documents. A person, organization, or corporate affiliation may appear in information for purposes of disclosure and/or authorship. Solicitations and job postings must not be submitted or used on the CMS Medicaid HITECH TA Web portal.

Anti–Trust: Messages that encourage or facilitate an agreement about the following subjects are inappropriate: prices, discounts, and terms or conditions of sale; salaries; profits, profit margins, and cost data; market shares, sales territories, and markets; allocation of customers or territories; or selection, rejection, and termination of customers or suppliers.

CMS and the MeT are not responsible for the content or the accuracy of the content available through these linked sites. Any hyperlinks to other Web sites are provided only for the purpose of convenience and do not constitute a referral to or endorsement of any of these sites, or the owners, services, products, and content on these sites.

Member and User Obligations: As a member and/or user of this Web portal, you are expected to: act in a professional manner; refrain from inappropriate language, defamation, dispersing spam (unsolicited bulk e-mail), slander, libel, disparagement to an individual or company; and act in a manner open and tolerant of others’ opinions. Information gained through Community of Practice (CoP) networking and/or participation may not be used for solicitation without an individual's permission. The CMS Medicaid HITECH TA Web portal adheres to copyright and trademark rules. Permission of the owner must be obtained before posting copyrighted materials. You accept responsibility for adhering to copyright and trademark rules to avoid violations.

The MeT reserves the right, but does not assume any responsibility, to: (1) remove from the Web portal any material posted by you that CMS and the MeT deems inconsistent with the foregoing commitments, including material believed to constitute a copyright infringement; and/or (2) terminate your access to all or part of the Web portal. However, the MeT cannot review all material prior to transmission on the Web portal or ensure prompt action with respect to objectionable material after it is transmitted on the Web portal. Accordingly, the MeT assumes no liability for any action or inaction regarding transmissions, communications, or other content that is provided by third parties. The MeT reserves the right to take any action it deems necessary to protect the personal safety of users of the Web portal and the public. However, the MeT is not liable or responsible to anyone for participating or not participating in the activities in this paragraph.

Indemnification: You agree to indemnify and hold harmless CMS and the MeT, its members, employees, agents, affiliates, third–party information providers, licensors, healthcare professionals, and others who are involved in the delivery of the CMS Medicaid HITECH TA Web portal services or information, from and against all liabilities, expenses, damages, and costs, including reasonable attorney's fees arising from your use of or any information obtained from the Web portal or from any violation by you of this agreement.

CMS and the MeT do not assume any liability for the content, materials, information, and opinions provided on this Web portal or information obtained from linked sites. Reliance on any such information is solely at your own risk. CMS and the MeT disclaim any liability for injury or damages resulting from the use of information contained on the Web portal.

Community of Practice Participation: As a member and/or user, you are encouraged to be an active participant of your chosen CoP. Participation can take many forms, such as regularly visiting the Web portal and using information as practice resources, mentoring and teaching others about the benefits of the Web portal, suggesting topics for community functions, and sharing information or skills that further the work of the CoP.
